MAPPI Jatim – Guna mengatasi masalah pertanahan yang sudah sangat lama dan tidak kunjung selesai, Menteri Agraria dan Tata Ruang (ATR)/Kepala Badan Pertanahan Nasional (BPN) Ferry Mursyidan Baldan menginginkan ada moratorium konflik pertanahan.
Lantaran kasus sengketa dan konflik pertanahan yang terlalu lama akan membebani pekerjaan instansi yang dipimpinnya.
Menurutnya, moratorium konflik pertanahan sangat ditentukan oleh valid-tidaknya bukti yang dimiliki, serta masih ada tidaknya orang-orang yang bisa memberikan keterangan.
“Jika kasus pertanahan yang sudah berusia 20 tahun lebih, saya kira sangat sulit untuk membuktikan hal tersebut,” ujar Ferry.
Ferry menuturkan, dimensi dalam penyelesaian sengketa dan konflik pertanahan adalah pada kemanfaatan dan kegunaan tanah. Ia menjelaskan, dalam kepemilikan tanah tidak hanya melihat dari sisi hukumnya, tetapi juga melihat pada apakah tanah tersebut digunakan dan dimanfaatkan secara benar.
“Jika ada orang yang memperlakukan tanahnya secara suka-suka, kita harus memberikan pengertian kepada mereka,” kata Ferry.
Penguatan tim penyelesaian sengketa dan konflik pertanahan Kementerian ATR/BPN juga dipandang perlu. Ferry menyarankan tim penyelesaian sengketa dan konflik pertanahan diperkuat oleh orang-orang yang memang ahli dalam hukum pertanahan.
Ferry menuturkan, dirinya memiliki harapan Kementerian ATR/BPN dapat mencegah konflik agraria di masyarakat dan setiap pimpinan di Kementerian ATR/BPN memiliki keberanian dalam mengambil keputusan terkait permasalahan tanah.
